Golf Working – Terms of Service

These Terms of Service (“ToS”) govern your access to and use of Golf Working’s websites, apps, and related services (collectively, the “Sites” and “Services”). By using the Services, you agree to these ToS.

If a translation conflicts with the English version, the English version controls.

1) Who May Use the Services

You may use the Services only if:

You can form a binding contract in your jurisdiction;
You comply with these ToS; and
Where applicable, you are a Golf Working member in good standing.

Do not use the Services if you are under the legal age of majority, legally incapacitated, or otherwise prohibited by law. If you use the Services on behalf of a company or organization, you represent you’re authorized to bind that entity to these ToS.

2) Privacy

Our Privacy Policy explains how we collect, use, and share information. By using the Services, you acknowledge our processing of personal data as described there, including storage and processing in other countries where we and our providers operate. Where required by law, we will seek your consent.

3) Content & Conduct

You’re responsible for your content and for complying with laws, rules, and regulations.

Do not upload, post, or transmit content that is unlawful, harmful, harassing, defamatory, obscene, invasive of privacy, infringing, misleading, spam, or contains malware. You also agree not to:

Impersonate others or misrepresent your affiliation;
Bypass or interfere with security or access controls;
Scrape, crawl, or send automated queries without permission;
Use the Services for unlawful, deceptive, or unethical purposes.

We may (but have no obligation to) moderate, remove, or restrict content or accounts that violate these ToS or applicable law.

License You Grant to Us

By submitting content to the Services, you grant Golf Working a worldwide, non-exclusive, royalty-free license (with the right to sublicense) to host, store, reproduce, modify, display, and distribute that content solely to operate, improve, market, and provide the Services. You represent you have all rights needed to grant this license.

Networking/Relationship Data

Golf Working may generate aggregated insights and relationship data from member interactions (e.g., referrals given/received, attendance), which Golf Working owns and uses to operate and improve the network.

4) Using the Services

The Services evolve over time. We may change, suspend, or discontinue any feature, impose limits, or restrict access at any time. We may show announcements or advertising in or around the Services.

By providing a phone number or email, you consent to be contacted about events, membership, and updates (you can opt out per our Privacy Policy).

5) Your Account

Some features require an account and, if applicable, an active Golf Working membership. Keep your credentials secure. You’re responsible for activity on your account.

6) Fees & Payments (if applicable)

Membership fees, event fees, and other charges will be presented at purchase and may change. Taxes may apply. If a payment method is declined, we may suspend or cancel access until amounts are paid. You agree to provide accurate billing information.

If we process cardholder data, we maintain appropriate security measures (e.g., PCI-DSS where applicable).

7) Intellectual Property

The Sites, Services, and all associated content, logos, and software are owned by Golf Working or its licensors and protected by IP laws. Except as explicitly allowed, you may not copy, modify, distribute, or create derivative works from the Services or our content.

8) Infringement Reports (Copyright & Trademark)

We respect intellectual property rights.

Report: Send a detailed notice identifying the work/mark, the allegedly infringing material, its location (URL), your contact info, and your good-faith statement that use is unauthorized.

If you’re in the U.S., you may submit a notice under the DMCA. If we remove content based on a notice, we may notify the uploader, who may submit a counter-notice as permitted by law.

9) Third-Party Services & Links

The Services may link to or integrate third-party sites, tools, SDKs, or content. We’re not responsible for their content or practices. Your use is governed by those third parties’ terms and privacy notices.

10) Electronic Communications

You consent to receive notices and disclosures electronically (via the Sites, email, or app). If you withdraw consent, discontinue using the Services.

11) Disclaimers

The Services are provided “as is” and “as available.” To the fullest extent permitted by law, Golf Working disclaims all warranties (express, implied, or statutory), including merchantability, fitness for a particular purpose, non-infringement, availability, accuracy, and error-free operation.

12) Limitation of Liability

To the fullest extent permitted by law, Golf Working and its affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, data, goodwill, or business, arising from or related to the Services or these ToS. Our total liability for any claim will not exceed the greater of (a) the amounts you paid to Golf Working in the 12 months preceding the claim or (b) NZD 100 (or equivalent).

Some jurisdictions don’t allow certain limitations—those limits apply only to the extent permitted.

13) Indemnity

You will defend, indemnify, and hold harmless Golf Working and its affiliates, directors, employees, and agents from any claims, losses, liabilities, damages, costs, and expenses (including reasonable legal fees) arising out of or related to: (i) your content; (ii) your use of the Services; (iii) your breach of these ToS; or (iv) your violation of law or third-party rights.

14) Suspension & Termination

You may stop using the Services at any time. We may suspend or terminate access immediately for any reason, including breach of these ToS, risk of legal exposure, non-payment, inactivity, or membership lapse. Sections that by nature should survive (e.g., IP, Disclaimers, Limitation of Liability, Indemnity, Governing Law) survive termination.

15) Governing Law & Venue

These ToS are governed by the laws of New Zealand (without regard to conflict-of-laws rules). You agree to the exclusive jurisdiction of the courts located in Auckland, New Zealand for any dispute arising out of or relating to these ToS or the Services.

16) Miscellaneous

Severability: If a provision is unenforceable, the rest remain in effect.
No Waiver: Failure to enforce a provision isn’t a waiver.
No Agency: These ToS don’t create an agency, partnership, or fiduciary relationship.
No Resale: You may not resell, rent, or commercially exploit access to the Services.
Force Majeure: We aren’t liable for delays/failures due to events beyond our reasonable control (e.g., natural disasters, strikes, internet outages, governmental acts).
Changes: We may update these ToS. We’ll change the “Last Updated” date and, where legally required, provide additional notice or seek consent. Continued use means you accept the updated ToS.
